Please read these terms carefully before using The Blackout Drive. By using The Blackout Drive, you agree to be bound by these Terms.

1. Definitions

"The Product" — The Blackout Drive, including all software, content, and documentation on the USB drive.

"Hutton Tech" — Hutton Technologies LLC, the developer and licensor.

"BEACON" — The AI assistant software included on the drive.

"You" / "User" — Any individual using The Blackout Drive.

2. License Grant

The Blackout Drive software is licensed under the Business Source License 1.1 (BSL 1.1). Subject to these Terms and the BSL 1.1:

✓ You MAY use the Product for personal, non-commercial purposes
✓ You MAY modify the software for personal use
✗ You may NOT use the Product to create, distribute, or sell a competing product or service
✗ You may NOT remove or alter copyright notices, trademarks, or license information

The full license text is in the LICENSE file included on the drive. On the Change Date (May 7, 2030), the software license converts to the Apache License, Version 2.0.

3. Intellectual Property

"The Blackout Drive" is a trademark of Hutton Technologies LLC. The software, UI design, system prompts, and original content are copyrighted works of Hutton Technologies LLC.

Third-party components (Ollama, Qwen3 models, Monaco Editor, etc.) are used under their respective open-source licenses. See the OPEN_SOURCE_NOTICES.txt file included on the drive for full attribution.

Library content (books, manuals, reference documents) consists of public domain works and openly licensed materials. No copyright claim is made on public domain content.

4. Permitted Use

You may use The Blackout Drive for:

— Personal education and reference
— Emergency preparedness and planning
— Offline AI assistance in any personal, non-commercial capacity
— Storing and encrypting personal files on the drive

You may NOT use The Blackout Drive for:

✗ Medical diagnosis or treatment (see Section 7)
✗ Legal advice in lieu of licensed counsel
✗ Any use that violates applicable law
✗ Commercial redistribution without a license from Hutton Tech

5. AI Disclaimer

BEACON is an AI language model running locally on your hardware. It:

— May produce inaccurate, incomplete, or misleading information
— Has no real-time knowledge and cannot access the internet
— Is not a licensed professional in any field
— Should never be the sole basis for critical decisions

AI responses are provided "as-is" for informational purposes only. Always verify important information with qualified professionals.

6. Content Disclaimer

The reference library on The Blackout Drive includes public-domain books, government publications, and openly licensed materials. This content is provided for educational purposes only, may contain outdated information, does not constitute professional advice, and is not endorsed by Hutton Technologies as current or authoritative.

7. Medical Disclaimer

THE BLACKOUT DRIVE IS NOT A MEDICAL DEVICE

Nothing on this drive — including AI responses, reference books, and medical guides — should be used as a substitute for professional medical advice, diagnosis, or treatment.

In any medical emergency: Call 911 (United States) or your local emergency number. Seek trained medical professionals immediately.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PRODUCT IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. IN NO EVENT SHALL HUTTON TECHNOLOGIES LLC BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM THE USE OF OR INABILITY TO USE THE PRODUCT. YOU ASSUME ALL RISK ASSOCIATED WITH THE USE OF THE PRODUCT.

9. Data and Privacy

The Blackout Drive collects no personal data. All data is stored locally on the physical USB drive. See our Privacy Policy for details.

10. Updates and Modifications

Hutton Technologies may release updated versions of The Blackout Drive. Updates are delivered via new drive images or the optional content channel — never pushed automatically. You are under no obligation to update. These Terms may be updated in future releases.

11. Termination

Your rights under these Terms terminate automatically if you violate any provision. Upon termination, you must cease all use of The Blackout Drive software. Termination does not affect any obligations or liabilities incurred before the termination date. Sections 4 through 8 survive termination.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.

13. Entire Agreement

These Terms, together with the BSL 1.1 License, our Privacy Policy, and the Medical Disclaimer, constitute the entire agreement between you and Hutton Technologies LLC regarding The Blackout Drive and supersede any prior agreements, understandings, or communications.

14. Governing Law

These Terms are governed by the laws of the State of Mississippi, United States, without regard to conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of the State of Mississippi.
